I. MEMBERSHIP TYPES & PRICING
A. Full Cabana
• Price: $6,075 + applicable tax
• Includes: Four (4) non-transferable memberships
• Additional Memberships: Up to four (4) may additional non-transferable memberships be purchased
• Maximum Occupancy: Eight (8) members
• Children Under 3: Free but are included in total capacity; must be registered and issued ID card
• Note: Children under 3 will not be admitted without registration
B. Cabanette
• Price: $4,850 + applicable tax
• Includes: Four (4) non-transferable memberships
• Additional Memberships: Not available
• Maximum Occupancy: Four (4) members
• Children Under 3: Free but are included in total capacity; must be registered and issued ID card
• Note: Children under 3 will not be admitted without registration
C. Locker
• Price: $1,050
• Includes: One (1) non-transferable membership
• Additional Memberships: One (1) additional non-transferable membership may be purchased
• Requirements: One member must be at least 18 years old
• Maximum Occupancy: Two (2) members
• Children Under 3: Free but are included in total capacity; must be registered and issued ID card
• Note: Children under 3 will not be admitted without registration
D. Membership
• Price:
o Adult: $750 + applicable tax
o Child (age 3 to 12): $675 + applicable tax
• Includes: Access to the pool and beach areas
E. Resident Pricing
• Qualification: Residents with supporting ID or proof of Seagate Residency will receive a 10% discount
• Resident Membership Price:
o Adult: $400 + applicable tax
o Child (age 3 to 12): $360 + applicable tax
• Includes: Access to the pool and beach areas
II. SCHEDULE OF PAYMENTS
• $500 Deposit: Due by October 31, 2024 to retain current accommodation
• 50% Payment: Due by March 15, 2025
• Final Balance: Due by May 15, 2025
• Refund Policy: Full refunds available if requested in writing no later than March 31, 2025. No refunds are available after this date and all sales are final. In the event the Agreement is signed after March 31, 2025, full refunds are available if requested in writing within seven (7) days following the execution of the Agreement. Thereafter, no refunds are available and all sales are final.
III. PERIOD OF OPERATION
• Season Duration: May 24, 2025 – September 1, 2025
• Limited Services: Until June 30, 2025
• Management Rights: The Club may close operations at any time, at its sole discretion, without
refunds or credits.
IV. REVOCATION OF MEMBERSHIP
Membership may be revoked by management at its sole discretion for violation of rules, local laws, disruptive behavior, or any reason management deems appropriate. No refunds will be given upon
revocation.
• Any Member or guest involved in litigation with Sea Gate Association, as reported to Club by the Sea Gate Association, will be denied access.
• Any attempt to bypass entry requirements will result in immediate revocation for all members of the associated Cabana, Cabanette or locker number.
V. TERMS AND CONDITIONS
Member Conduct and Rules
All members agree to follow all Club rules, including but not limited to:
• Fireworks, fires, cooking/barbecuing, illegal substances, intoxication, harassment and disruptive
behavior are strictly prohibited.
• Members are responsible for the conduct of their guests and for any damage caused by guests.
• Club may use media for promotional purposes unless a Photo Opt-Out form is requested
• If this contract is cancelled for any reason, Member’s deposit will be forfeited
• The Club shall establish hours of operation, which may be changed at the sole discretion of the Club. No one is permitted on the property after closing time. Sleeping or staying overnight in the
accommodations is prohibited.
• No alcoholic beverages of any kind will be permitted to be brought onto the Club’s premises by the
Member, or any of the Member’s guests. Any alcohol brought from outside is subject to
confiscation.
• Club reserves the right to enter all cabanas for the purpose of repair and maintenance and to
determine compliance.
• Club reserves the right to expel or remove any Member or guest from the Club for any reason, in
which event the Club will not issue any refunds or credits..
• Member shall use such entrance or entrances as may be designated by the Club.
• Member assumes responsibility for all damages caused by Member or guests to the Cabana, the
facility or any property of the Club.
• The Club assumes no liability regarding loss, damage or theft of any personal property of the
Member, or guests. Members and guests are solely responsible for any personal property they bring
to the Club and/or store overnight.
• Member acknowledges that the Club policy is to remove all personal property from the Cabanas.
Cabanettes and lockers at the end of the season.
• Member hereby agrees that they are accepting Cabana, Cabanette and lockers in their respective
“AS IS” condition.
• New York State Law prohibits minors under the age of Twenty-One (21) years of age from drinking
alcoholic beverages at any time in any place. Club reserves the right to require photo identification
of any Member, guest, or invitee.
• Member agrees to pay any extra charges for services which are not included in the original
agreement.
• in the event Member fails to pay any part of the payment on account when due, the Club shall have
the right to cancel this contract without further liability and retain any portion of the payment on
account already paid until such time as the cancelled Cabana, Cabanette or locker has been rebooked and the Club has recovered any losses.
• The person executing this contract expressly represents that he/she is of sufficient age and
understanding to enter into this Contract. (21 Or Older).
• Member agrees to observe the rules and regulations of the club, as they may exist from time to time.
• Members and guests are responsible for the supervision of any children accompanying them at all
times while on Club premises. The club assumes no responsibility for the supervision or
monitoring of any child at any time. No one under age 18 may enter the Club alone.
• All Members MUST swipe their Valid ID cards whenever entering the club.
• Smoking is NOT permitted in the club or on the beach. Prohibited smoking products incudes
cigarettes, cigars, e-cigarettes, vapes, and marijuana.
• Absolutely NO ALCOHOLIC BEVERAGES are permitted to be brought from outside into the Club premises.
• No guest is allowed on-site without an accompanying member.
• Bicycles, weapons, glass containers, or fishing are strictly prohibited.
• Climbing rocks or dangerous behavior are strictly prohibited.
• No pets or service animals are allowed on
Club premises, except as legally permitted.
The Club reserves the right to modify or suspend any rule(s) without prior notice.
Health & Safety
The undersigned hereby acknowledges that the use of the Club Facilities and any privilege or service
incident to membership is undertaken voluntarily with knowledge of known and unknown or unanticipated
risks of possible injury, property loss and/or death. The undersigned hereby freely accepts, on behalf of the
undersigned and on behalf of any family members and guests, any and all risks of injury, property loss
and/or death to myself, my guests and my family sustained while using the Club Facilities or while involved
in any event or activity incident to membership in the Club. The undersigned acknowledges the inherent
risks involved in recreational activities at the Club, including but not limited to drowning, slips, trips, falls,
dehydration, fractures, heat-related illness, cardiac events, collisions, and inclement weather. I understand
that such risks simply cannot be eliminated without jeopardizing the essential qualities of the activities
incident to Club membership. Therefore, by signing this Agreement, I agree that I, on behalf of myself and
on behalf of any minors and guest participating in the Activities with me (the “Co-Participants”) freely
accept and assume any and all of the risks existing in the Activities. My participation and any CoParticipant’s participation in the Activities is purely voluntary, and I elect to participate in spite of the risks.
I understand the description of these inherent risks is not complete and that other unknown or unanticipated
inherent risks may result in injury, property loss, and/or death, and I accept full responsibility for the
inherent risks identified herein and those not specifically identified.
Release and Indemnification
I, on behalf of myself, my heirs, legal representatives or anyone claiming by, under or through me, agree to
release the Club and the Seagate Association (the “Released Parties”), and their affiliates and related
entities, their successors and assigns, and their respective directors, officers, partners, members,
shareholders, employees, and agents from any and all loss, costs, claims, injury, damages or liability
sustained or incurred by me, my guests and/or my family resulting from or arising out of any conduct or
event connected with membership in the Club or with the use of any of the Club Facilities (the “Liabilities”).
Members assert they are in good health and not restricted by physicians from participation. THIS IS
INTENDED TO BE A GENERAL RELEASE OF THE RELEASED PARTIES FOR ANY AND ALL
LIABILITIES INCLUDING THOSE LIABILITIES CAUSED BY THE ACTUAL OR ALLEGED
NEGLIGENCE, IN WHOLE OR IN PART, OF ANY OF THE RELEASED PARTIES. This general
release is intended to extend to all Liabilities, including but not limited to, Liabilities for personal
injury, loss or harm, wrongful death, and property damage. As a condition of my membership in the
Club and undertaking the activities available at the club, I expressly agree on behalf of myself and any CoParticipants, my heirs, legal representatives or anyone claiming by, under or through me, to indemnify, hold
harmless and defend the Released Parties from and against any and all Liabilities claims, damages, injuries
or costs (“Claims”) to which the above Release of Liability applies, including, to the maximum extent
permitted by applicable law, Claims arising from the actual or alleged negligence, in whole or in part, of
the Released Parties, third-party Claims, and any Claim arising out of my own actual or alleged negligence
or other conduct. In accordance with these promises, I agree to reimburse the Released Parties for any
Claims, including reasonable attorneys’ fees that the Released Parties incur because of any such Claims
made against them. I agree that in the event of my death or disability, the terms of this Agreement, including
the indemnification obligations in this Section, will be binding on my estate, and my personal
representative, executor, administrator or guardian will be obliged to respect and enforce them.
VI. PROPERTY & LIABILITY
Personal Property
The Club is not responsible for lost, stolen, or damaged personal property. This includes items stored in cabanas, cabanettes or lockers.
Beach Chairs & Umbrellas
Beach chairs and umbrellas are not provided or placed by the Club. Staff may assist when available but they do so at their discretion. Overnight storage of beach chairs and umbrellas is allowed at members’ own
risk.
VII. GENERAL PROVISIONS
Membership Cards & Security
• Membership cards are required for entry
• Lost membership cards: $75 replacement fee
• Membership cards are non-transferable
• Fraudulent use of membership cards will result in immediate termination of the membership
without credit or refund
• All guests must wear wristbands
Parking
• First-come, first-serve basis
• Vehicles may be ticketed or towed if parked illegally or in a manner that blocks any access point,
fire hydrant, lane or crosswalk.
• The Club is not responsible for damages or losses to members’ vehicles or parking fines
VIII. AUTHORIZATION
I HAVE FULLY INFORMED MYSELF OF THE CONTENTS OF THIS AGREEMENT BY
READING IT BEFORE SIGNING IT. I UNDERSTAND THAT THIS DOCUMENT PROVIDES I AM ASSUMING THE RISKS ASSOCIATED WITH THE ACTIVITIES. I ALSO UNDERSTAND THIS AGREEMENT CONTAINS A FULL AND GENERAL RELEASE OF LIABILITY. I FURTHER UNDERSTAND THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN RIGHTS THAT I OR MY HEIRS AND LEGAL REPRESENTATIVES MAY HAVE TO
BRING A LEGAL ACTION OR ASSERT A CLAIM AGAINST THE RELEASED PARTIES. I FURTHER AFFIRM THAT I HAVE SIGNED THIS AGREEMENT VOLUNTARILY AND AS AN ACT OF MY OWN FREE WILL. NO ORAL REPRESENTATIONS, STATEMENTS, OR OTHER INDUCEMENTS TO SIGN THIS RELEASE HAVE BEEN MADE APART FROM WHAT IS CONTAINED IN THIS DOCUMENT.
By signing below, I/we acknowledge that I/we have read and understood this Agreement and agree to its
terms and conditions. I/we further acknowledge that I/we am/are responsible for informing all members and
guests associated with this account of all rules, regulations, and responsibilities herein. .
